This new deployment directly challenges a recent federal court ruling that declared the ongoing military occupation of the capital likely illegal. U.S. District Judge Jia Cobb had previously ordered the withdrawal of out-of-state troops, but the administration appears to be bypassing the judicial hold by citing emergency executive authority in the wake of the fatalities. The 500 incoming troops will join the estimated 2,300 Guardsmen already stationed in the city under the administration’s “Task Force,” which has been patrolling D.C. since August.
